5. General terms and conditions of sale

ARTICLE 1: GENERAL PROVISIONS

1.1 The customer undertakes to comply with and ensure compliance with all the provisions set out in this document, as well as the legal and regulatory requirements. These conditions of sale may be modified at any time without prior notice or notification. The conditions applicable are those in force on the date of the holiday.

1.2 Any confirmation of a booking by the customer implies full and unreserved consultation and acceptance of these general terms and conditions and of the terms and conditions of sale of the tariff booked. The customer’s agreement to these general terms and conditions and to the conditions of sale of the fare booked is obtained at the time of booking; no booking is possible without this agreement.

ARTICLE 2: PRICES

2.1 Prices are quoted in euros (€) and include VAT at the rate applicable on the day of booking. Any change in the applicable rate or any modification or introduction of new taxes will be reflected in the prices on the basis of the price excluding taxes plus the taxes in force and at the rate applicable on the date of the stay. 2.2 Rates are per room, for the number of people indicated and for the dates selected. Unless otherwise stated (special offers, packages), ancillary services are not included.

2.3 Visitor’s tax: the hotel collects a daily visitor’s tax per adult guest on behalf of the commune and the département. This tax is not included in the rates and must be paid to the hotel during your stay. The amount of this tax is set annually by municipal decree. In accordance with the law, failure to pay this tax will result in legal proceedings.

2.4 No stay booked before the introduction of any promotional offer will be reimbursed, even partially.

2.5 For long stays of more than 7 nights, payment will be requested in the middle of the stay.

ARTICLE 3: BOOKINGS

3.1 Bookings can be made by telephone, e-mail, post or on the www.hotel-radio.fr website.

3.2 A booking will only be effective if it is guaranteed by the customer, either by providing a bank card number with the date of validity or by paying a deposit.

3.3 Except in the case of special conditions relating to the tariff, payment for all services must be made directly to the hotel.

3.4 The customer is solely responsible for his or her choices and their suitability for his or her needs, and Hôtel RADIO may not be held liable in this respect.

ARTICLE 4: MEANS OF PAYMENT

4.1 Hôtel RADIO accepts cheques, cash and the following credit cards as means of payment: Bank card, Visa, Mastercard and American Express. All payments are made in Euro (€).

4.2 The Hotel RADIO offers an online reservation system on its website which, depending on the conditions of the rate, requires either online payment or a guarantee with a bank card number. The hotel uses the services of a trusted third party (Ingenico Payment Services), which protects and encrypts all sensitive data transmitted during the reservation process.

4.3 When the booking is registered, the credit card will be authorised to be debited. This will be done for information purposes only, and will under no circumstances be a charge to the credit card except in the case of a ‘non-cancellable – non-refundable’ promotional offer.

ARTICLE 5: CANCELLATION OR MODIFICATION BY THE CUSTOMER

5.1 In accordance with article L.121-21-8 12° of the French Consumer Code, the customer is reminded that he/she does not have the right of withdrawal provided for in article L. 121-21 of the French Consumer Code.

5.2 In the event of cancellation, modification of reservation or no-show, the special conditions of the reserved fare shall apply.

ARTICLE 6: STAY AT THE HOTEL

6.1 In application of the regulations in force, upon arrival at the hotel, the customer may be asked to complete a police form. An identity document must then be presented.

6.2 Rooms are available from 3 p.m. and the customer must leave the room before 11 a.m. on the day of departure. Failure to do so will result in an additional night being charged.

6.3 Depending on their type, rooms may be reserved for a limited maximum occupancy. For safety reasons, the customer undertakes not to accommodate additional people exceeding the maximum authorised capacity of the room.

6.4 The use of household appliances other than those supplied by the hotel is strictly prohibited, particularly cooking appliances.

6.5 The hotel accepts pets at no extra charge.

6.6 In the event of damage, the cost of restoring the room and an immobilisation indemnity will be payable by the customer. The cost will be passed on to the customer on presentation of an estimate.

6.7 The Hôtel RADIO has non-smoking rooms only. In the event of non-compliance, a fixed penalty of €150 per stay will be payable by the Customer.

6.8 The customer accepts and undertakes to use the room in a responsible and respectful manner. Any behaviour contrary to public decency and public order will lead the hotelier to ask the customer to leave the establishment without any compensation and/or without any refund if payment has already been made. If no payment has yet been made, the customer must pay the price of the nights consumed before leaving the establishment.

ARTICLE 7: FORCE MAJEURE

7.1 Force majeure is any event external to the parties that is both unforeseeable and insurmountable, preventing either the Client or the Hotel Owner from fulfilling all or part of the obligations stipulated in the contract. Cases of force majeure or fortuitous events are those usually recognised by the jurisprudence of the French Courts and Tribunals.

7.2 Each party may not be held liable towards the other party in the event of non-performance of its obligations resulting from an event of force majeure. It is expressly agreed that force majeure suspends, for the parties, the performance of their reciprocal obligations and that each party shall bear the costs arising therefrom.

ARTICLE 8: INFORMATION TECHNOLOGY AND FREEDOM

8.1 Pursuant to Act 78-17 of 06 January 1978, customers are hereby informed that their reservation is subject to computerised personal data processing. Users have the right to access and rectify the data entered, which may be exercised by contacting the Hôtel RADIO head office, 43 avenue Pierre et Marie Curie, 63400 CHAMALIERES. It is specified that this information is not communicated to third parties.

8.2 The Hôtel RADIO offers free Wi-Fi access enabling customers to connect to the Internet. The customer-user undertakes to ensure that the computer resources made available will not be used in any way for the purposes of reproduction, representation, making available or communication to the public of works or objects protected by copyright or neighbouring rights, such as texts, photographic images, audiovisual musical works, software and video games, without the authorisation of the holders of the rights provided for in Books I and II of the Intellectual Property Code, where such authorisation is required.

8.3 The RADIO Hotel has a video surveillance system in the common areas of the building.

ARTICLE 9: RELOCATION

9.1 In the event that it is impossible for technical reasons or force majeure for L’Hôtel RADIO to honour a reservation, the latter reserves the right to relocate the customer to a hotel of equivalent or higher category, offering services of the same nature. In this case, the cost of the transfer shall be borne by the hotelier, who shall not be liable for any additional compensation.

ARTICLE 10: LIABILITY

10.1 The Client shall be held liable for any damage, deterioration or act of vandalism that may occur as a result of the occupation of the premises and/or as a result of the participants and/or staff for whom the Client is responsible, whether to movable, decorative or immovable property belonging to the hotel or not. The Client shall bear the cost of restoring the property in accordance with article 6.6 of these conditions.

10.2 The photographs and videos presented on the hotel’s website are not contractual. Although every effort is made to ensure that the photographs, videos, graphic representations and texts reproduced to illustrate the RADIO Hotel give as accurate an idea as possible of the accommodation services offered, variations may occur, particularly due to changes in furniture or possible renovations.

10.3 During the online reservation process, on the www.hotel-radio.fr website, Hôtel RADIO may not be held liable for any damage resulting from the use of the Internet network, such as loss of data, viruses, disruption of service, etc.

ARTICLE 11: COMPLAINT PROCEDURES

11.1 All complaints must be sent to the RADIO Hotel in writing by registered letter with return receipt, within 8 days of the departure date of the holiday that is the subject of the said complaint. After this deadline, no complaint may be taken into account.

11.2 : Mediation: After having referred the matter to the management and in the absence of a satisfactory response within a period of 7 days, the customer may refer the matter to the Tourism and Travel Ombudsman, whose contact details and referral procedures are available on his website: www.mtv.travel. ARTICLE 12: APPLICABLE LAW

12.1 Any disputes arising from the application or interpretation of these general terms and conditions of sale shall be governed by French law and shall fall within the exclusive jurisdiction of the French courts.
